Whose house was demolished?
According to the PDA notice, the excavator was run at the home of Javed Mohammad. The name Javed Mohammad has been written on the notice pasted by the PDA on the house.
But Javed’s lawyers have filed a petition in Allahabad High Court claiming that the house that was demolished by the PDA is not owned by Javed Mohammad but by his wife Parveen Fatima. Parveen Fatima received this house from her parents as a gift before marriage.
Lawyers have written in his petition: “Since Javed Mohammad has no property over the house, any action by the administration to demolish the house goes against the basic principles of the law and is unfair to Javed’s family. Mohammad “.
Javed Mohammed’s lawyer, KK Roy, alleges: “To justify the demolition action, a notice has been pasted in the house on June 11 and there is a show cause notice on the date Javed Mohd or his wife Parveen Fatima never received it.
KK Roy says of this petition: “In Muslim personal law, a woman is the sole owner of property received as a gift until her death. Hindu law is different in terms of property and Muslim law is different. “The only owner of the property is Parveen Fatima and you gave notice to Javed Mohd. They told you this is not Javed Mohd’s house. But you ignored it.”
KK Roy says he will fight for this matter until the demolished house is rebuilt and is therefore ready to go to the Supreme Court.
The BBC tried to contact the PDA and Prayagraj DM, SSP and VC of the Prayagraj Development Authority on all these allegations, but could not be contacted until the report was drafted.
